In short
- As a general rule, a Romanian company can be sued in Romania (Regulation 1215/2012); check any choice-of-court or arbitration clause first.
- Order for payment: documented, certain and due amounts, no upper limit (Code of Civil Procedure art. 1014–1025).
- Small claims: up to RON 50,000 (Romanian) or EUR 5,000 (European procedure).
- Other disputes — damages, defective performance, contract termination — follow an ordinary lawsuit.
Three steps
1. Check the company
Verify the company’s registration, legal representative and whether it is in insolvency before choosing a procedure.
2. Choose the route
Order for payment for documented, certain and due amounts; small claims for lower values; an ordinary lawsuit for disputed or non-monetary claims; EU procedures in cross-border cases.
3. Enforce the decision
An enforceable title is executed in Romania through a court enforcement officer (executor judecătoresc). Precautionary measures may be requested in suitable cases.

- The contract, orders, delivery notes or other documents showing the obligation
- Unpaid invoices and the payment history
