Cadrul legal privind protecția datelor personale în România
În România, prelucrarea datelor cu caracter personal este reglementată direct de Regulamentul (UE) 2016/679 (GDPR), aplicabil din 25 mai 2018, completat de legislația națională de punere în aplicare.

Regulamentul general privind protecția datelor, direct aplicabil în toate statele membre.
- Legea nr. 190/2018
Măsuri de punere în aplicare a GDPR în România (inclusiv reguli pentru codul numeric personal, angajați și sectorul public).
- Legea nr. 102/2005
Înființarea și funcționarea Autorității Naționale de Supraveghere a Prelucrării Datelor cu Caracter Personal (ANSPDCP).
- Legea nr. 506/2004
Prelucrarea datelor și protecția vieții private în sectorul comunicațiilor electronice (inclusiv cookie-uri).
Repere esențiale
- Principii
- Datele trebuie prelucrate legal, echitabil și transparent, pentru scopuri determinate, limitat la ce este necesar, exact, pe o durată limitată și în condiții de securitate (art. 5 GDPR).
- Temei legal
- Orice prelucrare necesită un temei prevăzut la art. 6 GDPR: consimțământ, contract, obligație legală, interese vitale, interes public sau interes legitim.
- Încălcarea securității datelor
- Operatorul notifică ANSPDCP fără întârzieri nejustificate și, dacă este posibil, în cel mult 72 de ore de la constatare (art. 33 GDPR).
- Sancțiuni
- Amenzile pot ajunge, pentru cele mai grave încălcări, până la 20.000.000 EUR sau 4% din cifra de afaceri mondială anuală, oricare este mai mare (art. 83 GDPR).
