In short
- Postings to Romania are governed by Law 16/2017, which transposes Directive 96/71/EC as amended by Directive 2018/957.
- Romanian rules on pay, working time, leave and health and safety apply during the posting.
- After 12 months (18 with notification), almost all Romanian employment conditions apply.
- Social security usually stays in the sending State for up to 24 months, proven by the A1 form.
- A posting declaration goes to the Romanian Labour Inspectorate before work starts.
Three steps
1. Before the posting
Check whether the A1 form can be obtained, which Romanian pay and working-time rules apply, and prepare the Labour Inspectorate declaration.
2. During the posting
Respect Romanian minimum conditions, keep the required documents available for inspection and appoint a contact person where required.
3. Longer postings
Monitor the 12-month (or 18-month) threshold, after which almost all Romanian employment rules apply.
