Romanian insolvency assistanceHow to collect a debt from a Romanian company
The right route depends on whether the claim is documented, disputed or already decided by a court, and on the debtor's insolvency status. The usual options are:
Formal payment demand
A written demand (notificare / somație) sets a deadline for payment and documents the default. It is also a legal precondition for the Romanian payment order.
Romanian payment order (ordonanța de plată)
A simplified court procedure for certain, liquid and due claims arising from a contract or other written document, under Articles 1014 and following of the Romanian Civil Procedure Code (Law 134/2010). The debtor may apply to annul the order; current deadlines and court fees are checked against the consolidated text in force.
European Payment Order
For uncontested cross-border claims between EU Member States, Regulation (EC) No 1896/2006 offers a standard-form procedure as an alternative to the national payment order.
Ordinary claim or enforcement of an existing judgment
Disputed claims usually require ordinary proceedings. A judgment from another EU Member State is enforced in Romania under Regulation (EU) No 1215/2012, with the Article 53 certificate, through a Romanian judicial bailiff.
Insolvency of the Romanian company
If the debtor is in insolvency under Law 85/2014, the claim must be filed within the deadline set in the opening judgment. Filing does not guarantee payment, which depends on the proceedings and available assets.
Check the Romanian debtor first
Before choosing a route, the debtor's status, insolvency notices and pending cases are checked in official registers:
- ONRC – Romanian Trade Register (company status, representatives)
- Insolvency Proceedings Bulletin (BPI) – ONRC portal
- Romanian court portal – case search
- ANAF – taxpayer information by tax ID

Documents for a claim review
- Creditor and debtor registered names, company identification numbers and contact details
- Contract, orders, invoices and proof of delivery or services
- Outstanding amount, currency, due dates and payments already received
- Correspondence, acknowledgements and any objections to the debt
- Judgment or arbitral award, if already obtained, and accompanying certificates
- Opening judgment, insolvency notice and any stated filing deadline, if applicable
Working with a Romanian attorney from abroad
Start with a short description of the debt, the debtor and any pending deadline. We confirm the scope of Romanian-law assistance and explain the documents required for representation. Communication is available in English, Romanian and Hungarian; foreign-language documents may require certified Romanian translations.
The legal route and practical prospects depend on evidence, jurisdiction, debtor assets and insolvency status. Sending an inquiry does not itself start proceedings or suspend a deadline.

Debt recovery for overseas suppliers to Romanian customers
A foreign supplier should identify both the contracting company and the Romanian entity it believes owes payment. Include purchase orders, agreed terms, delivery or service records and correspondence about acceptance. Explain whether goods were supplied directly, through a distributor or through another group company. That commercial history helps frame the document review without assuming who is legally responsible.
Keep a separate record of each invoice and payment, including currency, partial settlement and objections. If your foreign lawyer has already issued a demand or commenced proceedings, provide the complete correspondence and current procedural position. We can scope Romanian creditor assistance around the file as it stands rather than repeating steps on the basis of an incomplete summary.
Identify the debtor and the contractual relationship
Begin with the debtor’s exact registered name and company identification number. A trading name, website or contact person alone may not identify the party that owes the money. Explain who signed the contract, who ordered the goods or services and who received the invoices. Identify any group company, guarantor or intermediary separately.
Provide a chronological account of the transaction: order, delivery, acceptance, invoice, due date, partial payments and later correspondence. If the debtor raised a quality complaint, set-off argument or other objection, include it. A claim review should address contrary evidence as well as the documents supporting payment.
Separate the debt from the procedure
An overdue invoice is the starting point, not a complete assessment of the legal route. The contract, jurisdiction terms, applicable law, evidence and debtor status must be reviewed together. Tell us whether a payment demand has already been sent, proceedings are pending or an enforceable decision has been obtained.
A commercial debt claim, enforcement of an existing title and participation in insolvency require different instructions. If the debtor has entered insolvency, send the opening notice rather than relying only on earlier invoice correspondence. Any stated deadline needs an individual review.
Reconcile the outstanding balance
List invoices individually with their currency, due date, original amount and payments received. Distinguish the principal balance from any contractual interest or other amounts you wish to claim. Supply credit notes, returned-goods records and disputed items so the proposed claim can be reconciled with your accounting records.
If settlement discussions continue, identify any proposal, acknowledgment or payment plan already exchanged. Tell us who can approve a settlement for the creditor. An inquiry, payment demand or negotiation must not be assumed to preserve a procedural deadline; the effect of any step requires a case-specific review.
When your customer is a Romanian company
For goods supplied to Romania, assemble the order, delivery records, acceptance documents and correspondence about defects or returns. For services, include the agreed scope, completion records and any approval or objection. Explain whether the contract was signed directly with the Romanian company or through another business.
Identify what you need now: a review before a payment demand, advice on a disputed invoice, representation in proceedings or follow-up on an existing judgment. If your finance team or foreign lawyer has already taken steps, include those documents so the Romanian instruction starts from the current position.
